1. About BuySmiley

BuySmiley sells two kinds of items: Retail items, sold individually, either from our own local stock or sourced per order from our AliExpress suppliers, and Wholesale items, sourced in bulk per order from our 1688 suppliers. Which kind of item you're buying affects delivery timelines, return eligibility, and warranty handling, as described in our Shipping Info, Refund Policy, and Warranty Info pages.

2. Accounts

• You must provide accurate, current information when creating an account or checking out.
• You are responsible for keeping your password confidential and for all activity under your account.
• If you check out as a guest, we automatically create an account for you using the email address you provided, so you can view your order history later. You can set a password for it at any time from your account settings.
• We may suspend or terminate accounts used for fraud, abuse, or violation of these Terms.

3. Orders and Pricing

• Prices are shown in BDT (Bangladeshi Taka) and are calculated from the underlying supplier cost, live exchange rates, and our current markup tiers. Prices can change between when you add an item to your cart and when you complete checkout — the amount confirmed at checkout is what you are charged.
• We reserve the right to refuse, cancel, or limit the quantity of any order, including after payment, if we suspect error, fraud, or abuse.
• Retail items sourced from our AliExpress suppliers, and all wholesale items, are ordered specifically for your order once confirmed, which is why these have more limited cancellation and return windows than items from our own local stock (see our Refund Policy).
• In the rare case a listed price or product description contains an error, we will contact you before fulfilling the order at the incorrect price.

4. Payment

We accept Cash on Delivery and online payment via SSLCommerz, bKash, and EPS. Online payments are processed entirely by those partners; see our Privacy Policy for details on how payment data is handled. Placing an order with an online payment method authorizes us to charge the confirmed order total through that gateway.

5. Shipping and Delivery

Delivery timelines differ by item type and are estimates, not guarantees — retail items sourced from our AliExpress suppliers, and all wholesale items, ship internationally from our suppliers and are subject to customs and carrier delays outside our control. 6. Prohibited Use

You agree not to:

• Use the Service for any unlawful purpose, or in violation of any applicable law in Bangladesh.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or our systems.
• Interfere with or disrupt the Service, its servers, or networks.
• Use automated means (bots, scrapers) to access the Service without our prior written consent.
• Submit fraudulent orders, payment information, or chargebacks in bad faith.

7. Prohibited Items

You may not use the Service to order, request sourcing of, or list any of the following, regardless of item type (retail or wholesale):

• Pornography and other sexually suggestive materials.
• Alcoholic beverages, including beer, liquor, wine, and champagne.
• Human body parts or organs.
• Bulk marketing tools, spam software, or unsolicited e-mail lists.
• Cable TV descramblers or devices intended to obtain cable/satellite signals for free.
• Child pornography in any form.
• Copyright-unlocking devices or pirated/unauthorized copies of books, movies, music, software, or other protected material.
• Counterfeit or unauthorized goods, including replicas, fake autographs, and counterfeit stamps.
• Drugs, drug paraphernalia, or unlicensed online pharmacies.
• Online gambling or betting products, including lottery tickets and sports bets.
• Fake government IDs, passports, diplomas, or titles.
• Materials or information promoting illegal goods or acts.
• Securities such as stocks, bonds, mutual funds, or related financial instruments.
• Tobacco and cigarettes or related products.
• Weapons, including firearms, ammunition, knives, or gun parts.
• Wholesale currency exchange or unauthorized currency trading.
• Multi-level marketing (MLM) or pyramid/matrix schemes.
• Intangible goods, services, or aggregation/consolidation businesses that are not clearly defined.
• Any other product or service that does not comply with applicable laws and regulations of Bangladesh.

Orders involving any of the above will be cancelled without refund (see our Refund Policy), and may be reported to the relevant authorities where required by law.

8. Intellectual Property

The BuySmiley name, logo, and site design are our property. Product images and descriptions for supplier-sourced retail and wholesale items are generally provided by or sourced from our suppliers and remain their property or that of the original manufacturer/brand. You may not copy, reproduce, or redistribute content from the Service for commercial purposes without permission.

9. Limitation of Liability

The Service is provided "as is." To the fullest extent permitted by law, BuySmiley is not liable for indirect, incidental, or consequential damages arising from your use of the Service, delays in delivery caused by our suppliers or courier partners, or product defects covered instead under our Warranty Info and Refund Policy. Nothing in these Terms limits any liability that cannot be limited under applicable law.

10. Governing Law

These Terms are governed by the laws of Bangladesh. Any dispute arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of Bangladesh.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page. Continued use of the Service after a change constitutes acceptance of the updated Terms.
